Terms and conditions of use governing the provision of data defined as open data from SBB AG

1. Scope of data use

The content defined as open data is freely available in machine-readable format at data.sbb.ch. Users can access the data via data.sbb.ch. The data obtained can be processed, analysed and published, including incorporating additional data, in accordance with the following provisions.

2. Registration

Users are not required to register or pay in order to obtain and use the file-based data provided by data.sbb.ch, but the number of requests is limited in the case of anonymous use (cf. section 3). Registration is required for a greater number of requests.

After registering, users will be issued with an access code (API key) in order to use service-based data. The access code can be withdrawn or blocked by SBB, particularly if the obligations outlined in section 4 are not adhered to.

3. Request limit

A maximum number of requests in a certain time is set for the usage of the service-based data provided by data.sbb.ch. Use of the data service is free of charge within this limit.

The limit applies individually for every registered user and overall for anonymous use.

If the set number of requests within a certain time is exceeded, the account will be blocked until the beginning of a new time period.

4. Obligations of data customers

4.1. Citing sources

The URL data.sbb.ch must be cited as the source for raw data in publications and analyses.

If the data forms part of a database that has many different data sources and does not just use data from data.sbb, sbb.ch need only be cited once in the list of sources contributing to this database. An indirect citation that mentions the database publisher citing sbb.ch will suffice. SBB decides whether data can be classified as a “database” and this classification can be requested at data@sbb.ch . SBB keeps a list of authorised databases.

4.2 Updating raw data

In the case of data processed for publications, the data user undertakes to regularly update the underlying raw data in a manner appropriate to its intended use.

4.3 Authorship

Processed data and analyses must be published under the name of the data user.

5. Links and comments

The pages and comments on data.sbb.ch may contain links to third-party websites, whose content SBB cannot control. SBB cannot provide any assurances or take any responsibility for this external content.

SBB monitors third-party entries and comments on data.sbb.ch to check whether they comply with the rules of netiquette . Any entries that violate the rules of netiquette shall be removed by the webmaster. Comments published always represent the author’s opinion and never that of SBB.

6. Liability and guarantee

SBB AG accepts no liability for damage or loss of any kind caused by the use of the data. It provides no guarantee that the published raw data, links and comments are up to date, correct, complete or accurate.

7. Misuse

Any misuse of the data shall immediately result in the relevant data user being banned from using any more data.

8. Amendments and addenda

SBB reserves the right to amend or add to these terms and conditions of use at any time.

9. Data protection

SBB AG’s Privacy Policy applies.

10. Applicable law and place of jurisdiction

These terms and conditions of use are governed by Swiss law. The exclusive place of jurisdiction is Bern.

In the event of discrepancies between the various language versions, the German version shall be deemed binding.

11. Authorised databases

Authorised databases are exempt from the requirement to reference the data source opentransportdata.swiss directly in accordance with the terms and conditions of use. These databases are listed below. A request to exempt a database not listed here may be made by submitting the relevant form.
